RULES

The following rules are in place to ensure all participants and guests have a safe, enjoyable experience at G-Man Golf. Common sense and consideration for the safety of all participants and guests are always expected, even if it’s not explicitly listed here.

ALL guests must be at least 21years of age with valid ID.

Be alert of where you stand or walk and stay out of someone’s range of swing.

Report any accidents immediately.

Members and Guests are financially responsible for any damage caused by failure to follow the processes or the Rules, or caused by their careless, reckless or intentional actions.

Guests acknowledge G-Man Golf is under video surveillance. Tampering with cameras or damaging equipment by not following procedures may lead to loss of membership privileges and you will be liable for any damage caused.

Guests and members acknowledge that photography and/or video may be recorded and used for promotional purposes without compensation.

If you bring your own clubs, please make sure club faces are clean before playing.

We have club cleaning equipment for your convenience.

Keep food and drinks at the tables provided. NO FOOD OR DRINK INSIDE SIMULATOR AREA at any time!

No drugs, smoking or vaping in the facility.

Be respectful and courteous of other participants/groups in the facility.

We would love for you to be able to finish your “last hole”, but if another group is booked after you, we will transition the simulator to the next group promptly at the end of your booking time.

Failure to abide by any of the above procedures may result in cancellation of the remainder of your paid simulator time without compensation and cancellation of your membership with no refunds.

Obey all verbal and posted rules and instructions.

No running starts or other movement that would move your feet from the mat during your swings are allowed.

Only the player taking a turn is allowed near or on the turf. All other guests must always stand a safe distance behind always until their turn to hit. A safe distance means being behind the turf and at least seven (7) feet from the person swinging.

Members and guests are responsible for the safety of others around them and should always check their surroundings before swinging a club.

Members and guests will follow the dress code and personal code of conduct.
PARTICIPANT WAIVER AND RELEASE OF LIABILITY

In consideration of the opportunity to use the G-Man Golf (Company) building, golf simulator, and related equipment and components (Services),
I, __________________________ (Participant), collectively known as the Parties, hereby agree to the following Waiver and Release of Liability (Agreement):

Waiver and Release of Liability: My participation in and use of the Services is voluntary and subjects me to the possibility of physical injury (which could be minimal, serious, and/or result in death) and loss of or damage to my property (Risks), as a participant and or guest. It is also reasonably foreseeable that my careless or reckless use of the Services will result in damage thereto. Accordingly, I agree with the following:

I recognize the physical exertion involved in the use of the Services, and attest and certify that I am physically fit to participate safely, and I have not been advised otherwise by a healthcare professional;

I will be solely responsible for all medical and related bills that I may incur because of any injury, as well as costs related to loss or damage to my property, that I may sustain as a result of my participation in the Services, including those sustained on the premises where the services are conducted and while I am traveling to and from such premises, regardless of the location or mode of transportation;

I will be personally liable for all damage to the building, simulator and related equipment caused by my careless, reckless or intentional actions and the actions of all guests I bring to G-Man Golf, and;
-
This Agreement shall be binding on my estate, heirs, executors, administrators, successors, and assigns, as well as any other party asserting a Claim on my behalf or on behalf of my estate.

General Provisions:

I hereby expressly agree that (a) this Agreement shall be governed and construed according to the laws of the state of Oregon without regard to its conflict of laws provisions and (b) any action or proceeding concerning any Claim or the meaning or effect of any provision of the Agreement shall be conducted only in the state courts located in Washington County Oregon, I expressly submit to the jurisdiction of such courts.

This Agreement contains the entire understanding between and among the Parties concerning these matters. No waiver, modification, or amendment of any of the terms of this Agreement shall be effective unless made in writing and signed by the party to be charged.

I hereby expressly agree that if any portion of this Agreement is held invalid, the balance of the Agreement shall nonetheless continue in full legal force and effect.

I AM FULLY AWARE OF THE RISKS ASSOCIATED WITH GOLF, INDOOR GOLF, SIMULATOR GOLF, AND THE SERVICES OFFERED BY G-MAN GOLF, INCLUDING THE POSSIBLE RECKLESS CONDUCT OF OTHER PARTICIPANTS AND GUESTS. I HAVE CAREFULLY READ THIS AGREEMENT, AGREE TO ACCEPT ANY AND ALL INHERENT RISKS OF PROPERTY DAMAGE, PERSONAL INJURY, OR DEATH, AND SIGN IT VOLUNTARILY. I AGREE THAT THIS PARTICIPANT WAIVER AND RELEASE OF LIABILITY IS IRREVOCABLE AND EFFECTIVE AS OF THE DATE SET FORTH BELOW AND FOR ALL TIMES THAT I USE G-MAN GOLF FACILITIES AND OR SERVICES HEREAFTER.

I warrant that I have read and understand the Rules and Participant Waiver and Release of Liability. I understand this Agreement involves my waiver and release of significant rights and my assumption of significant indemnification responsibilities in participating in the Services.
